Pivora is a business-to-business experiential and event marketing agency. We provide event strategy, design, production, and related marketing services to corporate and enterprise clients (the “Services”). The specific scope, deliverables, fees, and timelines for any engagement are set out in a separate written proposal, statement of work, or service agreement agreed between you and us (the “Engagement Terms”). These Terms govern general use of the Platform. Where these Terms conflict with signed Engagement Terms, the signed Engagement Terms will prevail for that engagement.

2. Who May Use the Platform

The Platform is intended for businesses and their authorised representatives. By using the Platform or making a payment, you confirm that you are authorised to act on behalf of the entity you represent and to enter into a binding commitment on its behalf. You agree to provide true, accurate, and complete information, and you are responsible for all activity carried out through your dealings with us.

3. Payments

Payments to us may be made through payment links or other methods we make available, which may be processed by third-party payment service providers. By making a payment, you authorise us and our payment partners to process the transaction. We do not store your card or banking credentials; these are handled by the relevant payment service provider in accordance with their terms and applicable law. You agree to pay all fees set out in the applicable Engagement Terms or invoice.

4. Cancellations and Refunds

Cancellations and refunds are governed by our Refund and Cancellation Policy, available on the Platform, read together with the applicable Engagement Terms.

5. Intellectual Property

All content on the Platform, including its design, layout, graphics, text, and logos, is owned by or licensed to us and is protected under applicable law. You may not copy, reproduce, or use any part of it without our prior written consent. Intellectual property created during an engagement is governed by the applicable Engagement Terms.

You agree not to use the Platform for any purpose that is unlawful, fraudulent, or prohibited by these Terms or by applicable Indian law. You agree not to attempt to gain unauthorised access to the Platform or interfere with its operation.

This clause does not limit any obligations we owe you under signed Engagement Terms.

To the fullest extent permitted by law, our total liability arising out of your use of the Platform is limited to the amount paid by you to us through the Platform for the transaction giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law. Liability arising from the delivery of Services is governed by the applicable Engagement Terms.

You agree to indemnify and hold harmless Pivora, its affiliates, and their respective officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

11. Force Majeure

Neither party will be liable for any failure or delay in performing its obligations where such failure or delay results from an event beyond its reasonable control, including natural disasters, government action, civil unrest, strikes, pandemics, or failure of public infrastructure or networks.
